Lawyerdude says: Cherie from Oklahoma won her case in court recently. She is “Karinawebb” in the following dialogue. She took the time to inform me that she won. She had some kind words. I appreciate her kind words and I am pleased to see that she won her case. The key word on this page is “Empowered”. Empowerment of pro se litigants is what I am all about.
The “Marylin” must be Marylin Trevino, (530) 459-____, a brilliant family law activist. Marylin is at trevino@hotmail.com and plaintuff@msn.com She lives in northern California in Humbolt county maybe.
Cherie rang me up on Yahoo instant messenger. Here is what she said:
Yahoo Instant Messenger conversation. 8:38 pm Pacific time. Monday, August 9, 2004.
karimawebb: Hey Dude, I'm not going to keep you, I just wanted to thank you for everything you did for me and my family. Talking to you and your introducing me to Marilyn did wonders for our confidence and definitely made a difference when we went to court
Lawyer Dude: Thanks. I don't recognize your handle.
Lawyer Dude: Please remind me
karimawebb: karimawebb, the muslim that called you about helping with writing a motion to dismiss in June
Lawyer Dude: Oh yes.
Lawyer Dude: Did it work out okay in court?
Lawyer Dude: You are in Texas?
karimawebb: the allegations were dismissed, the judge said that we were attorneys in disguise
karimawebb: we're in OKlahoma
Lawyer Dude: Wow! So you won!
karimawebb: Yes
Lawyer Dude: And the judge praised you!
Lawyer Dude: I don't hear that everyday.
karimawebb: they dismissed rather than entertain the motion
Lawyer Dude: Congratulations! Good for you!
karimawebb: we cited everyone
Lawyer Dude: This is really good news.
Lawyer Dude: Thanks for keeping me posted!
Lawyer Dude: I will post this on my group!
karimawebb: the GAL, our attorney, the DA , DHS.. I think the only person that didn't get cited for something was the janitor
Lawyer Dude: They got cited?
Lawyer Dude: Do tell!
karimawebb: what we lacked, is the very thing you gave us. The proper format
Lawyer Dude: Okay, well, stay in touch please!
karimawebb: we made note that the children's attorney hadn't spoken to them in 4 months, that the DHS worker refused to allow visits with our 17yo and our attorney refused to file anything on our behalf "FORCING" us to act pro se
karimawebb: then we filed a motion to compel attorney compliance
karimawebb: the judge said that he had never seen one of those
Lawyer Dude: Wow that is creative! Excellent!
Lawyer Dude: Make it up as you go
karimawebb: usually he gets "ineffective counsel", but never in his 20+ years on the bench had someone come to him and requested that he make their attorney do his job
Lawyer Dude: The bureaucrats cannot handle creative motions.
karimawebb: they can't handle motions period
Lawyer Dude: You are brilliant.
Lawyer Dude: Give yourself a pat on the back
Lawyer Dude: Job well done
Lawyer Dude: I am so pleased to hear about your dead bang winner!
karimawebb: Well what they forget to mention is that if you have a court appointed attorney, that if for whatever reason, he withdraws or quits or you fire him, the court doesn't have to get you another attorney
Lawyer Dude: In California, if you fire your appointed lawyer for cause then they appoint a new one.
Lawyer Dude: Okay, I am going to run off and post this.
Lawyer Dude: later, gater!
karimawebb: I'm sending you the motion to dismiss and the motion to compel
Lawyer Dude: Thanks. I am receiving and storing it.
karimawebb: Hopefully someone else might be able to use the template
Lawyer Dude: Yes. I will post it.
karimawebb: And I wanted you to know that we really couldn't have done it without you.
Lawyer Dude: thanks so much.
karimawebb: After talking to you, I felt empowered
Lawyer Dude: We did good, huh?
Lawyer Dude: I can feel the spirit
karimawebb: oh it was wonderful
Lawyer Dude: Coming through the monitor.
karimawebb: my wayward 17yo is in a bootcamp and all the allegations were dismissed
Lawyer Dude: Great!
karimawebb: This is all YOU
Lawyer Dude: Well, I know you are religious and you gotta give thanks to Allah also!
Lawyer Dude: Okay.
Lawyer Dude: We will chat some other day I hope.
Lawyer Dude: Bye for now.
Then this email came:
I'm including the motions that you inspired.
1. We won our case. All allegations were dismissed.
We could not have done this without your inspiration and wise advise. We walked into court confident
and dare I say a little cocky.
The judge stated that one of us had to have studied the law! I said to him "No, your honor, we just
have people who know what they're doing telling us what we should be doing".
I'm enclosing both motions that we filed (the judge had never seen a motion to compel before LOL), so that if someone else needs a template, you have them.
Thanks again.
Cherrie
