Here is what happened in Buzz’s case:

In Chronological Order.

I must give credit to Buzz. Buzz won his own case by finding the winning cases on appeal. Sleeping is not driving! Buzz found the Mercer case and that was the winning precedent. I wrote the papers using the cases that Buzz found!

Also, If you look in the caption on the demurrer and some other motions, you can see that I filed a “list of concurrent motions”. Most of those motions did not get written - because the demurrer won the case early.

After winning the drunk driving case Buzz had to deal with the DMV. Some uneducated woman hearing officer lost her temper and stopped our phone hearing after I explained the law to her. She was not a lawyer. Maybe not a high school graduate. On February 11 they did something to Buzz’s license. I forget. On July 22 they set it aside. Buzz’s license never did get suspended.

Prosecutor committed perjury by saying

that Buzz was driving drunk.

We wrote letter #5684 on Feb 13.

They did not answer. Maybe

we did not send it. Don’t remember.

Very early in the case I telephone the

arresting officer. He admitted that Buzz

was not driving. I inquired about his

having checked the box marked “driving”.

Incidentally, Buzz did not get a ticket in this case.

They filed a police report instead.

We filed a demurrer.                                             #5681               Feb 20              March 20                       We continued it.
