Sunday, January 29, 2006. Much has happened at the home of Jason Lisle. The Hurricane after Katrina went right through their yard but did not destroy the home. However, there was roof damage and some water leakage. They had to repair the roof.
The case has not moved anywhere in a year. I wrote a letter to the bad appointed lawyer. He resigned. The court appointed a new lawyer. He has done nothing. No news is good news. The friends of Jason Lisle have been bad boys. One accidentally burned down gramma’s house where this friend had a meth lab. The fire killed a woman. They released this bad friend out on bail again.
The atmosphere in this court is “you in a heap a trouble, boy “
This district court is a branch court linked back to Jasper. I found out on 16 December 2004 that they meet only on the 1st Thursday and the 3rd Friday. Jeez, why didn’t the clerk or the judge or my client mention this to me or my client. I told the clerk “This 2 day a month thing is something you might mention on your web page”. She did not know that they have a web page.
On Thursday, December 16, 2004 at 8:35 pm central time I sent an email to the prosecution informing him of this page, in the hopes that we may litigate more efficiently

This is a record of the stupid actions of weak-minded oppressive Texas government employees. They are ignoring the paper and the law. They are conspiring with the magistrate who works at the gravel pit. He is the sheriff’s brother. They are trying to send this boy to state prison or put him on probation. They are trying to keep this boy from finding out what happened to his friends, although you gotta ask yourself “You expect me to believe that this boy Jason cannot do some telephone work and find out who the lawyers are for his former friends?

Court appearance Nov 9. Nobody advised defendant that court is held only twice a month and that his motions would simply be put over and lumped together on one day. That ruined defendant’s efforts to pace himself and have only one motion heard per day. We have the same rights as O.J. Simpson. You did not here Judge Lance Ito tell Johnny Cochran that court will be held two days per month and we will jam all your motions in to that morning before the trial - one court day.

Prosecutor Davis refused to even acknowledge receipt of our discovery demand which is at: http://www.lawyerdude.s5.com/6569.html Attorney Palaschak called Davis. Davis would not return Palaschak ’s call. Investigator Springer says that their policy is flexible and that they will give us NO discovery without a court order. Now we must make a Brady motion / application for a discovery order order.

Dec 16th Nobody showed up for the suppression motion #6566. Presumably this and the other motion are lumped together for December 17th. This is unconstitutional - having court only twice a month - but we can live with it provided that the court does not jam is up. If we waive time then they should be expected to permit us time to argue our motions.

Friday December 17, 2004. December. 3rd Friday or the month. 8:30 a.m. Jason Lisle and his Dad went to court today. Dad spoke for Jason. It was off the record; most everything was off the record. In my later conversation with Steve I reminded him to stay on the damn record! Then they went on the record. Judge appointed a lawyer from Jasper in another county. He did the judge pick this lawyer?
Monday, December 27, 2004. I called Steve Lisle. They met with the new lawyer K______ today. As expected, he is a young guy - green. He will talk to the prosecutor and see what kind of deal can be had. Steve asked the new guy about prosecuting our 5 motions. The new guy is, as usual, jealous. He has “not invented here” syndrome. He says “just leave the law to me” - meaning: “I don’t need no help from some lawyer from California:. Steve says that this guy won’t do anything. Steve’s faith in me is reaffirmed. I have 5 motions on the back burner. I need to write them.

Tip leads Newton deputy to lab

A Deweyville man already indicted on a murder charge has been arrested again and accused of making methamphetamine.
Curtis Lee Pitman, 30, was one of two people arrested late Monday on a Meth Watch program tip. The person calling said Pitman had been seen buying chemicals used in the drug's production, police reported.
Newton County Deputy James Blankenship subsequently went to a trailer park where Pitman lives off old Texas 87. After Pitman gave permission for a search, Blankenship found what looked like a lab in a bedroom closet.
Less than two grams of methamphetamine was found, Blankenship said.
Selina Deroche, 24, also was arrested at the trailer.
Both were charged with manufacturing of a controlled substance and were being held Tuesday night in Newton County. His bond is $250,000, while hers is $100,000.
Sheriff Joe Walker said this was the 13th lab found in the county since late 2004.
In December, a Newton County grand jury indicted Pitman in connection with the June 2004 death of Toni Romero, according to the district clerk's office.
Romero, 33, died from burns she received in a house fire in Hartburg near Deweyville. At the time, investigators said the house, which was destroyed, contained a methamphetamine lab, according to The Enterprise archives.
I received a report from Jason’s Dad that the court appointed a replacement lawyer for Lawyer k. I read the transcript of this court session. K used the excuse that Jason already had a lawyer. K saved face for himself. K based this on the transcript where Jason said that I was his lawyer. I included this partial transcript in the accusatory letter where I accused Lawyer K of doing nothing.
It is now 2 years from the date of arrest. Nothing has happened in the case. A co-defendant accidentally blew up a house while out on bail. This explosion killed an innocent woman who lived in the house.
Jason has kept his nose clean and continues to work as a union electrician. His Dad has recently been elected business rep which means that the dad works at the union office managing assignments and such.
A hurricane after Katrina went right through Jason’s yard. They had to fix the roof.
The sheriff lost the election. There is a new sheriff now.
I have not inquired further in this case except to keep in touch with Jason’s dad. Best to let sleeping dogs lie.
Below this line are the motions that we need to file yet. However, this case seems to have died without any further prosecution of Jason. It has been over 2 years since his arrest.
1. Upgrade suppression motion using statutes in 6657
2. Motion to appear pro hac vice. Russell v Sanders motion.
3. Motion to appear telephonically.
4. Brady motion.
5. Demand for police reports.
6. Motion to vacate suppression motion and all other actions in the case until we receive our documents and information in discovery.
